Anna Mae Davis, 9 Ridge Road, reminder from Ridge Road - waiting on answer for two drains to be installed on Ridge Road. Would like committed answer. Also would like answer on reassessment of property. When we received our reassessments ther was a huge gap compared to our neighbors. Someone has to know how these figures are arrived at, would like to know Mayor - requested Matt to review that.
Jack Phillips, 200 McGrath Road - stop further discussion on the 63-20 or the Town building a new skating rink in Town. If this is wonderful the Town would not have to spend the money. It could be support privately. Voters said not to putting in a recreation center. Do not go against what the citizens of this town have said and borrow money and commit the Town to this. Do not bond money for recreation facilities.
Kathy Hale, 54 Orchard Hill Drive, I agree with Jack Philips. Feel that the skating rink is an unnecessary project. The reason for doing private public partnership is to create jobs. Historically SW only gives tax abatements to create jobs and this will not create jobs. Will also drive out an existing facility that already does this purpose. Need to be sketpical on numbers that are presented. Should fix the budget and this is not one of them.
Rob O'Connor - 126 Krawski Drive, Park & Rec Commission - speak in support of 63-20 Corporation and recreation center. This has a lot of components that would support the whole community. This is not just a hockey rink and the rest of the items will help with Town. Will free up the community center to be used for the seniors.
Craig Zimmerman, 5A Amato Drive, Support of the Recreation Center. Here to talk about the in-door pool. SW is the only Town its size that does not have a pool. None of the projects that we are talking about were in the referendum. The 6320 financing, I am not an expert and would like to listen to the whole concept. Basketball court is needed. need a full size gym. The seniors benefit also. The biggest taxpayer in town is Evergreen Walk and this will help that development as well as other businesses in Town.
Don Gonsalves, 40 Bayberry Trail - have lived in Town for 7 years. I attend 85-90% of these meetings. There should be a referendum for this proposal. In my opinion they are trying to ramrod this through. On the agenda tonight people should be allowed to speak after item 6. I would like to see the numbers and would like to analyze them.
John - 220 Laurel Street - 6320 is not ethical. It may be legal but not ethical. I I fear there may be challenge of that opinion that it is legal. Opens up for dangerous possibilities. 6320 should not happen. This could be done privately. The Town should look at developing Lawrence Road with something. Ethically need to say no to this concept.
Matt Riley, 12 Heatherwood Drive - support this - the difference between bonding a project where you go out to referendum. Council needs to educate the difference betwen bonding and having 6320 issue bonds.
Mike Sullivan, 24 Jared Court - 6320 hope in discussions each councillor will give their opinion whether it is a good option or not. why is the counicl not addressing issues such as the elementary schools. why is this the town's priority.
Al Larson, Jacques Lane - Park & Recreation Commission - the hockey rink received a lot of press and the rest of the project has not be addressed. The indoor pool - we are the only Town of our size that does not have a pool. We started youth swim team, 2005 we began winning youth swimming - since 2005 we have placed 1 or 2 from 15 towns. (2005-2012). South Windsor is very competitive in swimming and would benefit from a pool in town. 6320 is not something to be feared. It was authorized by the IRS as a legal vehicle and has been used. Has been used for a variety of items.
John Mitchell, 41 Eagle Drive - taxes at this point are high enough - seems like we are trying to drive seniors out of Town. Feel the charter was crafted years ago to avoid something like this. Avoid the will of the people not to be able to speak about a project of this size. Thanked Dr. Anwar for carefully look at this proposal and not supporting it. Would like all council members to speak on tis issue.
4. Communications
Anwar - recognize community member who has done so much for town - John Throwe - will be ---- veterans hall of fame. Inducted hall of fame Superintendent and Board of Ed being selected - congratulations recently members of community - new year
Delnciki - Patriotic Commission - thanked the for program at schools and at VMP. There is not a discussion on the hockey rink proposal- requested tht Council members who have questions to submit them in writing.
5. Town Manager's Report [Per Town Council Rules, this segment of the meeting shall not exceed ten (10) minutes unless extended by the Mayor, with the consent of the majority of the Council.]
Galligan - 385,000,000 deficit - hoping town is left alone this year. next year there will be larger shortfalls. based upon tht have talked to staff about putting freeze on budget. we are going to make adjustments ahead of time to cut back. If there is anything additional the Town Council would like please inform me. 3 abatements - trying to create jobs. There are principles here tonight to answer questions. Smoke Detector program - that program is strong - would like to continue program. Regional Animal Control - Manchester approved. Tolland budget - we have started process with staff and hoping to have somkething by the end of the year for TC to review. Recreation Facility - have 6320 discussion tonight. CT Studios - have meeting tomorrow - will be requesting information - will email council Executive session -
Bazzano - urge everyone to look at their assessments. Is is possible to get charlie in here.
Anwar - please explain shortfall in state budget Galligan - there will be a deficit of 385,000,000 - next year 1.1 - 1.2 or 1.3 billion dollar deficit. because revenue not coming in. that is a concern for us. Will have some suggestions and will lobby very hard. Town Council will need to pass resolutions. It is a concern. Anwar - late January will know? Galligan - should know January or February Anwar - congratulate staff in regards to the storm. The coordination between Town and utility company was very effective. Think Town needs to have fuel storage system that will hellp the community in a disaster. I also think as a Council need to discuss having generators at all of the gas stations in Town. We should learn from what is happening in New Jersey and New York
Yagaloff - as a Council we have not received any information on the tax assessment. we need to know what is going on with the grand list. Very surprised that the taxpayers do not get this information. Public needs to know taht even though your assessment has gone down your taxes are not going down. Galligna - process does not end until the end of december. Woul dlike new budget to Council by December Yagaloff - if they have done the assessments - why wouldn't the taxpayers know what the total of those assessments are. Residents need to be able to budget for this assessment. public needs to know what has happened with the assessments, real property grand list. Would like to know information Gallign - people have the right to appeal so we have to wait for appeal process to be done. Can review this in December. Yagaloff - need to know average increase or decrease. Council will be bringing spending freeze resolution forward.
Delnicki - we are looking at extraordinary times. this could effects grants coming to the town
Havens - commend the Registrar of Voters for orderly manner way the election was carried out. suggest that the Executive Session not be held until later. opnion written by TA - Delnicki - we did not receive that information
6. Items for Discussion
A. 63-20 Corporation
Dwight - discussed the 63-20 Corporation opinion letter. How many votes to go forward - would take 5 members to approve this. TheTown would not have to repay so that is why do not have to go out to referendum. Competitive bidding is not required because it is not the Town project. Cost to defend - do think the Court would support it. If went on for months and month it could be expensive. I would guess before someone brought suit forward the Recess at 8:00 p.m.

6320 corporation would not be a for profit - a for profit could however participate with the project.
Beaulieu - the primary diffeence between the town bonding and 6320 corporation bonding - indebtedness for project - the Town would be in the default situation. 6320 the Town is not taking on indebtedness. The Town is taking on payment every year by the Town. Dwight - if the town were to lease portion of the project. Cindy - the town decides to lease - the project is not going along as anticipated? Dwight - would be determined by the terms of the lease. Cindy - the term of the lease does not have to match the term of the indebtedness. Dwight - the person or entity which the 6320 corporation may want to sell the bonds, they may want to ask the town for a commitment. Cindy - the bonds fro 6320 corporation do not go through same type of sale as bonidng? Dwight - assume you are correct but David Panico Cindy - the prevailing wage - should we seek additional advice fromother counsil Dwight - concluded that prevailing wages would be required. I thought this was one of the vehicles that the Council was reviewing to finance this and could spend more time on that issue.
Yagahloff - understand that if there is no lease the Town could walk away. if the funds from the town would be critical to - 6320 could effect other businesses. If the Town was not committed I would imagine the Town would not get involved. Always thought would be a smaller scale project. policy wise when we talk about 6320 projects in a larger project, it seems public would be concerned about transparency because it is in avoidance of a referendum. Large project needs to be out in the open and the public should know about everything with this. The Council and the public needs to know exactly what is happening. Information needs to be given information at the meetings - this council will not support project unless we know what is going on at all times. If we are going to get into 6320 discussion - eveyrthing needs to go to the council so the public can see. Recommend TC accept poliicy especially if large project - do not feel comfortable weighing on 6320 - if policy is not accepted - that we should get everything as it happend - then will not support 6320 corporation.
Bazzano - agree with councillor yagaloff - there are numjbers out there that have been quoted - we need to see that information - Galligna - met with Dan - when you embark on something like this - need to know components of proposal - need to do a request for proposal - Dan Marsh's group has done these previously. Dan would be willing to do a request for proposal. could get entity to come in and have someone run the hockey rink as a private development - also could have town run the rest. need to go through process. We have looked at number but not ready to go over those meetings. There are people saying tht would be a public private partnership. Bazzano - town owned land could not be used - or would that have to go to referendum Galligan - some communities lease the land, you would not give up the land - will look at that. Bazzano - 6320 corp. gets formed Galligan - Tow Council appoints certain members to the committee. want to appoint people who are familiar with what you woudl like to accomplish. Bazzano - so theyw ould be officers of that Galligan - they are separate entities of the town. dwight - once you apoint people to serve on the board the TC would not Bazzano - should get pricing regardless how this goes, when we look at a one million dollar fire truck that does not go to referendum, why? Galligan - lease through municipal bank - get low rate on that. Town can lease a lot of things - you are borrowing money but you have the option to say we do not want this anymore.
Delnicki - Fire House property - thre were monies in the referendum? Galligan - that was referendum where we did not build the fire house on. Delnicki - we bought property McCann - want ot make sure all understand the power and the authorizity of the council. - would like to see if my understanding is correct of the different options that the Council could use to finance a project. Dwight - will be glad to do thta - will contact you. McCan - 6320 concept for each project a separate 6320 corporation would need to be formed for each project? Dwight - that would be the decision of the council if they would like to have one 6320 corporation for this project or seprate one for each project (pool, rink, etc).
Anwar - could you share with us what could go wrong with 6320 corporation? Dwight - do not have a great deal of expertise with 6320 - this isa common financing device. this does not create risks that the town would not haave with financing a different way. you would have to follow statutes, etc. it has to be done properly. Anwar - there have been places where they could not make ends meet and they were not sustainable - Dwight - that is possible with any project. Anwar - 6320 could be risky if the project is not viable. Dwight - 6320 could borrow money cheaper - if the project does not make sense financially wo pays the lease for a facility? Galligan - if the town were to lease a portion of the project - Anwar - lease would come from where? Galligan - the budget. Some Towns use it as a mechansim Anwar - what is the liklihood if the town says will lease for one yar - woudl the money be corporation would have to come up with the difference. Anwar - if someone suggest we pay x amount of money for x amount of years - that will be taxpayers money tht will be used? Galligan - yes Anwar - important that people understand that it is the tax dollars that would be at risk. Gallian - Council would hve to decide on objectives. do request for proposal - waht council wants out of this facility - council should know what geting into. I have open book policy and will meet with anyone who comes in. Anwar - once you have further communications the whole Council should be included. Galligan - had two meetings -
Delnicki - 6320 corporation would be considered agent of municipality, as an agent would like to know rights, duties and responsibilites of the agent would be and what that means? Dwight - appears in the IRS regulations that explain why 6320 corp is able to issue bonds on no tax basis. it does not mean agent of the munciiaplity. liability. Delnicki - if had one or two year lease, could bond holder sue the town for walking away from a project Dwight - I think the answer is no (issue bonds more cheaply and protect the town). Delnicki - wouldl ike you to check taht question. Delnicki - if have a referendum that failed, the town could turn around and do ti with a 6320 corporation? yes Delnicki - are there any linits on the size of aproject that 6320 corporation can do? Dwight - there is a vehicles Delnicki - could a town seek to stop doing referendum and do eveyrthign with a 6320 corporation? Dwight - would have to look into that. Galligna - road repairs no - these project are more project specific. Delnicki - requested that Dwight look into the road issue. if town entered into 6320 - petition for referendum could that referendum stop this? Dwight - to stop a resoliton yes
Yagaloff - 6320 are permissable and legal. first need to ask if resonable cost to the town, is there substantial benefit for the town. if 1M project per year tht would be hard to approve. viability of the project is very important. The only information have on the project is what we received the first night when there was discussions. additional information is required - should have a resolution for the Council Galligan - request for proposal should be done - those proposal would then be brought back to the council and a decision could be made. Yagaloff - proposal has to be decided upon in a work session. Council needs realistic information. Galligan - could put a propsal together Yagaloff - project needs to make sense and be financially viable.
Beaulieu - not close to having numbers - tonight learned about 6320 corporation. tonight was about learning about 6320 corporation. with the formation of 6320 corporation the maangemetn of it is borne by the 6320 corporation - 6320 corporation would oversee construction if 6320 corpoartion were done. if bonidng then town oversees construction. dwight - correct. Beaulieu - 6320 take care of the project until the town takes over then the town can decide how those areas would be managed. Snyder - merits of importance of a projects needs to be considered. At this time there is no projects. The TC needs to give the TM clear direction of what we want him to do.
Delnicki - we as a council have not even determined if we want a project. Galligan - if brought in group that wants to bring hockey rink in - would I be critized for speaking about that. Delnicki - if you are looking for economic development project you would have that ability. we need to be kept apprised. Galligan - if I would have to get permission, items would not get done. Delnicki - projects were discussed for a length of time
Anwar - we are putting you in difficult situation, McCann - disagree Yagaloff - on this one the horse is out of the barn. the group should know about the project - it would be unfair - everyone should know what is going on. Request talks with private developers be brought to the Council. The Counicl can then inform the public. Galligan - have always had a process. Yagaloff - private business in town would be effected. for teh town to be in competition with a business in town would be dangerous. if we are going to bring in private developers to compete with existing business. should not use town resources to compete with businesses in town. Galligna - it has happened - Yagaloff - I am sure the Mayor will have discussions regarding the project. Town should not be using town resources

Dwight - that would be the decision of the council if they would like to have one 6320 corporation for this project or seprate one for each project (pool, rink, etc).
Anwar - could you share with us what could go wrong with 6320 corporation? Dwight - do not have a great deal of expertise with 6320 - this isa common financing device. this does not create risks that the town would not haave with financing a different way. you would have to follow statutes, etc. it has to be done properly. Anwar - there have been places where they could not make ends meet and they were not sustainable - Dwight - that is possible with any project. Anwar - 6320 could be risky if the project is not viable. Dwight - 6320 could borrow money cheaper - if the project does not make sense financially wo pays the lease for a facility? Galligan - if the town were to lease a portion of the project - Anwar - lease would come from where? Galligan - the budget. Some Towns use it as a mechansim Anwar - what is the liklihood if the town says will lease for one yar - woudl the money be corporation would have to come up with the difference. Anwar - if someone suggest we pay x amount of money for x amount of years - that will be taxpayers money tht will be used? Yagaloff - 6320 are permissable and legal. first need to ask if resonable cost to the town, is there substantial benefit for the town. if 1M project per year tht would be hard to approve. viability of the project is very important. The only information have on the project is what we received the first night when there was discussions. additional information is required - should have a resolution for the Council Galligan - request for proposal should be done - those proposal would then be brought back to the council and a decision could be made. Yagaloff - proposal has to be decided upon in a work session. Council needs realistic information. Galligan - could put a propsal together Yagaloff - project needs to make sense and be financially viable.
Beaulieu - not close to having numbers - tonight learned about 6320 corporation. tonight was about learning about 6320 corporation. with the formation of 6320 corporation the maangemetn of it is borne by the 6320 corporation - 6320 corporation would oversee construction if 6320 corpoartion were done. if bonidng then town oversees construction. dwight - correct. Beaulieu - 6320 take care of the project until the town takes over then the town can decide how those areas would be managed. Snyder - merits of importance of a projects needs to be considered. At this time there is no projects. The TC needs to give the TM clear direction of what we want him to do.
Delnicki - we as a council have not even determined if we want a project. Galligan - if brought in group that wants to bring hockey rink in - would I be critized for speaking about that. Delnicki - if you are looking for economic development project you would have that ability. we need to be kept apprised. Galligan - if I would have to get permission, items would not get done. Delnicki - projects were discussed for a length of time
Anwar - we are putting you in difficult situation, McCann - disagree Yagaloff - on this one the horse is out of the barn. the group should know about the project - it would be unfair - everyone should know what is going on. Request talks with private developers be brought to the Council. The Counicl can then inform the public. Galligan - have always had a process. Yagaloff - private business in town would be effected. for teh town to be in competition with a business in town would be dangerous. if we are going to bring in private developers to compete with existing business. should not use town resources to compete with businesses in town. Galligna - it has happened - Yagaloff - I am sure the Mayor will have discussions regarding the project. Town should not be using town resources
